Tersus Group and other entities, either individually or collectively, are the commercial “Operators” of the www.tersusgroup.co.uk website although software, hosting and other content functions may be provided by “Service Providers” or “Business Partners”, “Affiliates” or “Associates”. The Operator’s Service Providers are intended third-party beneficiaries of these Terms of Use. The site is not intended or directed or actively marketed for individuals under 18 years of age.

2. Change In Terms

The Operator may change these Terms from time to time with notice given to Customers. Your continued use of this website after any changes constitutes your acceptance of the new Terms. If you do not agree to abide by these or any future Terms, do not use the website and do not download materials or references from it.

3. Change to Website and related content

The Operator may terminate, move, modify, suspend or discontinue any aspect of the website including the availability of content, downloads, approved out-bound links or content we control. Unless the Operator, its Affiliates, Service Providers or Business Partners specifically agrees otherwise, the following terms apply to all information and content appearing on this website;

5a) Confidentiality – The following restrictions apply to use of material on the website (i) any information marked Private or Confidential or words of the like including ‘Not for public use or distribution’. If you access such information, you are not authorised to publish, share, forward or disclose it to others, (ii) if any information contains restrictions on use or disclosure, you are to comply with such restrictions and (iii) you will keep all restrictive content intact without amendment and advise Tersus Group senior management you have access to information and will comply with non-publication or communication of such confidential content helping Tersus Group to abide by the strict corporate Policy Statements published on the website.

5b) Copyright – The Operator, its Service Providers, Affiliates and Business Partners each reserve copyrights in all content and data that each provides for the www.tersusgroup.co.uk website. This includes but is not limited to design, text, software, technical drawings, configuration, graphics, other files and their coordination, selection and arrangement. You may not prepare derivative works or content based on such content found at www.tersusgroup.co.uk in whole or part without prior written permission of the copyright owner. 6. User Conduct – Security

You agree not to;

6a) disrupt or interfere with the security or otherwise abuse the website, its function, functionality, content, connectivity, accessibility directly or via linked or related websites

6b) disrupt or interfere with any user’s quiet enjoyment of the site or linked sites or services

You also agree to keep a username and password provided to you by the Operator, Service providers, Affiliates or Business Partners safe and secure without disclosing to third parties, and to remain responsible for all actions and communications undertaken or transmitted under your account.

7. User Conduct – Online communities and other interactive areas

The website may well contain areas where you can link to or comment or share or post comment with other site users. You agree that you will not share, post, disseminate on this site or others, unlawful, harassing, libellous, abusive, offensive, threatening or obscene communications or comment of any kind or materials which may infringe or violate a third party’s copyright, trademark, trade secret, privacy or other proprietary content that could constitute a criminal offence, give rise to civil liberty or otherwise violate any applicable law or regulation, or that are otherwise actionable, including without limitation, content that evidences bigotry, racism, sexism, hatred or promotes or conveys information about illegal activities or harm against anyone. The Operator reserves the right to remove content or materials it deems objectionable or which falls short of the Environmental, Social and Governance Statement and related company policy appearing on the www.tersusgroup.co.uk website.

8. Termination

Registered Users agree to notify the Operator immediately when he / she no longer works for the company or an entity with access to password protected or log-in sections of this website. All termination advice must be shared promptly to the designated Tersus Group relationship manager or client service manager with a subject line ‘NOTICE OF TERMINATION CHANGE TO USER STATUS’. The terminator must specify the reason for termination and the due date. The termination will not affect the obligations or rights of parties arising before the termination date. Termination may be required or effective earlier either (a) after transmission of an Acknowledgement from the Operator to the user expressly confirming termination, or (b) midnight on the first business day following the Operators receipt of the termination notice.

9. Links and Third Party Content

Tersus Group’s website may from time to time link to third party websites (for example Health & Safety Executive) – these and similar links are provided for your convenience and do not constitute approval, endorsement, sponsorship or recommendation by the Operator for content, opinion, products or services available through the third party.
All links to the Tersus Group website must be approved in writing by the Operator, except where the Operator consents to links in which; (a) the link is a text-only link which may be embodied in an email or business to business communication related to relevant website content, (b) the link displays the full web page content including Tersus Group contact details thereby ensuring the user they are not under a false misrepresentation that content is associated wrongly with a third party, (c) the link provider does not falsely claim or imply association if no such association exists or has been approved by Tersus Group in writing. The Operator, Service Providers, Associates and Business Partners reserve the right to revoke consent for links at any time at its sole discretion.

You agree that neither the Operator, Service providers, Affiliates or Business Partners have no liability whatsoever to you for any material, content or information or data you receive as a result of a link through a third party.

Unless the Operator, Service Providers, Affiliates or Business Partners agree otherwise in writing, the following terms shall apply;

Under no circumstances, including, without limitation, negligence, shall the Operator, its Business Partners, Affiliates or Service providers, vendors or suppliers be liable for any claim for loss or damage of any kind, including direct, indirect, special or consequential loss or damage of any kind, arising from information obtained directly or indirectly from this website to the extent permitted by law.

  • This website is live and therefore accessible worldwide.
  • These Terms of Use shall be governed by and construed in accordance with UK Law and you agree to submit to the jurisdiction of UK Law in respect to disputes.
